Your photos stay yours.
Artly turns your photos into AI-generated art. This policy explains exactly what leaves your device when you do that, who receives it, and the control you keep over it.
Who we are
Artly is an iOS app that edits photos with AI. The data described here is controlled by the developer of Artly, who you can reach at dangthao.hv@gmail.com — that address is the fastest route for any request under this policy.
Artly has no user accounts. You are never asked to register, and we hold no profile that identifies you by name.
What we collect
We keep collection to what the app actually needs to work.
Photos you choose
When you pick a photo to transform, iOS hands the app only that one picture — Artly never gets access to your library and never scans your camera roll. The photo you picked is then sent to our AI provider so it can be turned into a result. See section 03 for exactly what happens to it, and section 04 for how the app treats the face in it.
Purchases
Credit packs are bought through Apple in the App Store. Apple tells the app that a purchase succeeded; we never see your card number, billing address, or Apple Account details.
Usage & device data
- Device details (model, iOS version, language, country) and the app version.
- Analytics events — screens opened, features used, purchases and ad views — plus crash reports when the app fails.
- Identifiers used for advertising and attribution: Apple's advertising identifier (IDFA), which is only available if you allow tracking, and the vendor identifier (IDFV).
- Approximate location inferred from your IP address by our ad and analytics providers — Artly itself never asks for GPS location.
Your photos & AI generation
Artly has no server of its own. Your photo goes directly from your device to our AI provider, Pollinations, which runs the models that produce the result. It does not pass through any system we operate, and we keep no copy of it.
What happens when you tap generate
The photo you picked is sent to Pollinations together with the style you chose. Its models read the picture only so far as producing your result requires — recognising where the subject is and how the style should be fitted to them — and return the finished image, which the app saves on your device. If a model declines a request on content-moderation grounds, Artly retries once with a different model at the same provider. Nothing is sent before you start a generation, and nothing about the picture is kept by us afterwards.
About Pollinations, the one company that receives your photo
Pollinations is a generative-AI platform based in Berlin, Germany. Your uploads and results are handled by it under its own published documents, which are worth reading alongside this policy:
- Pollinations privacy policy — how it handles what it receives, including retention.
- Pollinations terms of service — the terms your generation runs under, including its content moderation.
Pollinations is open source. Its platform is developed in public on GitHub under the permissive MIT licence, so the code that receives a request, runs it and returns the result is not something you have to take on trust — anyone can read it, and the project is built in the open by a contributor community that inspects and files issues against it continuously. You can review it yourself at github.com/pollinations/pollinations. We chose an open provider for exactly this reason: it is the only way a claim about what happens to your photo can be checked by someone other than us.
Neither we nor Pollinations use your photos to train models. If you are not comfortable with a particular photo leaving your device, do not select it — nothing is uploaded until you start a generation.
Face data
A photo you bring to Artly is usually a photo of a person, so this section says on its own how the app treats a face. Where anything else in this policy could be read differently, this section governs face data.
What we collect
One thing: the photograph you choose yourself, which may contain your face or the face of someone in your picture. That photograph, processed to produce the edited image you asked for, is the entirety of the face data Artly handles. Nothing is read from your library until you pick a picture and start a generation — iOS hands the app that one picture and nothing else.
Artly does not create a faceprint, a face template, a face scan, a face embedding or any other biometric identifier. It does not measure or store the geometry of anyone's face. It never recognises, matches, verifies or identifies a person, never compares one photo against another, and never builds a record of a face that could be recognised again later.
How we use it
Only to create the edited picture you asked for, in the style you tapped, and to show it back to you. There is no other use, and none planned. Face data is never used for advertising, marketing, analytics, profiling, user identification or age estimation, and neither we nor our AI provider use your photos to train models.
Who it is shared with
One company: Pollinations, our AI provider, which runs the models that produce the result. It receives the photo and the style you chose, for that one generation, and returns the finished image. It acts on servers outside your country, including in the United States, under its own privacy policy and terms of service, including its own content moderation.
Pollinations is an open-source platform: its code is public on GitHub under the MIT licence at github.com/pollinations/pollinations, developed in the open and inspectable by anyone. Section 03 explains why we picked a provider you can audit rather than one you have to trust.
Face data goes to nobody else. It is not shared with our advertising partners, our analytics providers or any data broker; it is not sold; and it is not disclosed for advertising, marketing or any purpose unrelated to producing your picture.
Where it is stored
Artly operates no server, and we store no face data anywhere. The photo goes directly from your iPhone to Pollinations and the result comes directly back. There is no Artly database, no Artly cloud storage and no Artly backup holding your pictures. The only lasting copy is the finished picture on your own device: in the app's storage so the My Photos tab can show it, and in your camera roll as well if you tap Save.
How long it is kept
- By us: not at all. We hold no copy at any point, so our retention period for face data is zero.
- At Pollinations: only for as long as answering the request takes, under that provider's own retention policy. We ask it to keep nothing, and because Artly has no user accounts, no identifier travels with the photo that could be used to retrieve it later.
- On your device: the finished pictures stay until you remove them.
How to delete it
Because nothing is held off your device, deletion is entirely in your hands: remove a picture in My Photos, or delete Artly to remove every picture at once. If you would like written confirmation that we hold nothing, email dangthao.hv@gmail.com and we will send it.
How we use it — and on what basis
If you are in the EEA or the UK, the GDPR requires us to name a legal basis for each purpose. Here they are:
- To create your images — sending your photo and prompt to the AI provider. Basis: performance of our contract with you.
- To fit the chosen style to the person in the photo — the processing of face data described in section 04. Creating the picture you asked for is the only use of it, and there is no other planned. Basis: performance of our contract with you — the edit you asked for cannot be produced without it.
- To run credits and purchases — tracking your balance, granting credits you buy or earn, charging a generation. Basis: performance of our contract.
- To keep the app working — diagnosing crashes, measuring which features are used, delivering configuration remotely. Basis: our legitimate interest in a stable, improving product.
- To show ads and measure them — including personalised ads, attribution and ad-revenue reporting. Basis: your consent, collected through the prompts described in section 08.
- To meet legal obligations — tax, accounting and responding to lawful requests. Basis: legal obligation.
We do not sell your personal information for money. We do share advertising identifiers with ad partners for personalised advertising, which some laws — including California's — treat as a "sale" or "sharing". Section 11 explains how to opt out.
International transfers
The providers listed above operate outside your country, including in the United States. Where data is transferred out of the EEA or the UK, it is covered by the safeguards those providers put in place — typically the European Commission's Standard Contractual Clauses, or an adequacy decision where one applies.
Ads, tracking & your choices
Artly is free to install and is paid for by ads and by credit purchases. You will see ads on the onboarding screens, a full-screen ad on the way into the app, and rewarded ads that you choose to watch in exchange for credits. Ads never appear inside a generation you paid credits for.
Two separate prompts appear when you first launch the app:
- The ad-consent form (EEA and UK only), from Google's User Messaging Platform. Your answer decides whether ads are personalised. Decline and you still get ads, just non-personalised ones.
- Apple's tracking prompt (App Tracking Transparency). Only if you allow it can our partners use the IDFA to link your activity across apps.
You can change the tracking answer at any time in iOS Settings › Privacy & Security › Tracking. To withdraw or change ad consent given in the EEA or UK form, email us and we will action it.
Stored on your device
Some things never leave your iPhone at all:
- Your generated images — saved automatically into Artly's own storage so the My Photos tab can show them. They stay there until you delete them, or delete the app.
- Your credit balance — held in the device keychain.
- Settings — your chosen language and how many rewarded ads you have watched today.
Saving a result to your camera roll is a separate, explicit step: iOS asks for add-only photo access the first time, and Artly can only add pictures — it can never read or delete what is already there.
Data retention
Face data has its own retention terms in section 04. We hold no photos ourselves, so there is nothing on our side to delete — your uploads live only as long as our AI provider needs them to return a result, under its own retention policy. Analytics and crash data are kept for the retention windows set by Firebase and AppsFlyer. Purchase records are kept as long as tax and accounting rules require, then removed. Everything held on your device disappears when you delete the app.
Your rights & choices
- Access, correction & deletion — email us to request a copy of what we hold about you, to correct it, or to have it deleted.
- Objection & restriction — you can object to processing based on our legitimate interests, or ask us to restrict it.
- Withdraw consent — turn off tracking in iOS Settings, or email us about the ad-consent form, as described in section 08. Withdrawal does not affect processing that already happened.
- Opt out of "sale" or "sharing" — declining Apple's tracking prompt, or turning it off later in iOS Settings, is how you opt out under California law.
- Photo access — manage Artly's add-only access under iOS Settings › Privacy & Security › Photos.
- Face data — delete a picture in My Photos, or delete the app, and nothing remains; see section 04. Choosing not to start a generation is how you decline the processing entirely, since nothing is read or sent before you do.
- Complain — if you are in the EEA or the UK, you may lodge a complaint with your local data-protection authority.
Because Artly has no accounts, a deletion request may need details that let us find the records — for example the date and approximate time of a purchase. We answer requests within the time the applicable law allows, normally one month.
Children
Artly is not directed to children under 13, or under the higher minimum age that applies in your country, and we do not knowingly collect their data. If you believe a child has provided us information, contact us and we will delete it.
Changes to this policy
We may update this policy as the app evolves. When we do, we will revise the "Last updated" date above and, for significant changes, notify you in the app.
