Terms of Use

The deal for creating with Artly.

These terms are the agreement between you and Artly — they also serve as the end-user licence agreement for the app. By downloading or using Artly, you accept them, so they are worth a read before you start generating.

Accepting these terms

By installing or using Artly, you agree to these Terms of Use and to our Privacy Policy. If you don't agree, please don't use the app.

You must be at least 13 years old, or older if your country sets a higher minimum age for using a service like this. If you're using Artly on behalf of a business, you confirm you're authorised to accept these terms for it.

Your licence to use Artly

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Artly on Apple-branded devices that you own or control, for your own lawful use, and as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. You may not copy, resell, rent, reverse-engineer, or redistribute the app or its underlying technology.

How credits work

Artly runs on a single currency: credits. There is no subscription and nothing renews automatically — you buy credits once, and they are spent as you generate.

In short

One currency, one kind of purchase. If an app store listing, an ad or an older version of these terms suggested a weekly subscription or a paid "PRO" tier, that is no longer how Artly works — and nothing in the app charges you on a recurring basis.

Ads

Artly is free to install and is supported by advertising alongside credit purchases. You'll see ads during onboarding, a full-screen ad on the way into the app, and rewarded ads that you choose to watch to earn credits. We don't control which specific ads a network serves. How ad personalisation and tracking work, and how to change your choices, is set out in the Privacy Policy.

Your content

You keep ownership of the photos you upload and of the images you generate. You are responsible for the photos you use — by uploading one, you confirm you have the right to do so and that it doesn't infringe anyone else's rights.

You grant us and our AI provider a limited licence to process your uploads solely to provide the service: generating your result and returning it to you. Your content is not used to train models.

Acceptable use

To keep Artly safe for everyone, you agree not to use it to create or share content that:

You also agree not to attempt to bypass the credit system, automate the app, or interfere with the services it depends on. Our AI provider applies its own content moderation and may refuse a request independently of us. We may suspend access if these rules are broken.

About AI results

Results are produced by machine-learning models and are inherently unpredictable. A generation may not match what you pictured, may not preserve every detail of the original photo, and may be refused by the provider's moderation. Different users giving similar inputs can receive similar outputs, so we can't promise your result is unique. You're responsible for checking a result before you publish or rely on it — particularly anywhere that a realistic image of a person could mislead.

Our intellectual property

Artly — including its name, logo, design, prompts and software — belongs to us and is protected by intellectual-property laws. These terms don't give you any right to our branding or technology beyond using the app as intended.

Disclaimers

Artly is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will be uninterrupted or error-free, or that a third-party service it depends on will stay available. Nothing here limits rights you have as a consumer that cannot be waived under the law of your country.

Limitation of liability

To the extent permitted by law, Artly and its team won't be liable for indirect, incidental, or consequential damages arising from your use of the app, including lost images or lost credits. Where liability can't be excluded, it's limited to the amount you paid us in the 12 months before the claim.

Termination

You can stop using Artly and delete it at any time; deleting the app also removes the generated images stored inside it. We may suspend or end your access if you break these terms or misuse the service. Sections that by their nature should survive termination — ownership, disclaimers, and liability — continue to apply.

Artly is distributed through the App Store, and Apple requires the following to be part of this agreement:

Governing law & changes

These terms are governed by the laws applicable in your country of residence, without regard to conflict-of-law rules, and nothing in them removes the protection of mandatory consumer law where you live. We may update these terms as Artly evolves; we'll revise the "Last updated" date above and, for significant changes, notify you in the app. Continuing to use Artly after an update means you accept the new terms.
